1. What This Notice Covers
This notice covers email VLStudio sends you: what legal basis we rely on to send marketing email, what "unsubscribe" actually does today, and how the in-app notification toggles (marketplace updates, weekly digest, and similar preferences) relate, or currently do not relate, to what lands in your inbox. It supplements our Privacy Policy and should be read together with Privacy Policy, Section 2.4 on the newsletter.
2. Legal Basis for Marketing Email
Under the EU/UK ePrivacy framework (PECR in the UK, the equivalent e-privacy rules implementing the ePrivacy Directive in EU member states) and GDPR, marketing email to an individual generally requires either:
- Consent, a clear, informed, opt-in action taken by you (for example, checking a box to subscribe to the newsletter), or
- Soft opt-in, a narrower exception available for existing customers: if you bought a similar product or service from us, we may email you marketing about similar products, provided we gave you a clear chance to opt out at the point of collection and in every message since.
Once a proper consent-capture mechanism exists, VLStudio intends to keep an auditable record of consent for each subscriber: the source of the consent (which form, which flow, which point of sale) and the timestamp it was given. That record does not fully exist today in an auditable form; see Section 6.
3. Unsubscribe Today: What Actually Happens
Our Privacy Policy, Section 2.4 and prior communications may have referred to an unsubscribe link; this notice is the accurate, current statement and takes precedence: the mechanism is not yet automated, and a request routed through Section 8 is the reliable way to act on it today.
4. In-App Notification Toggles
The web portal's notification settings include toggles such as marketplace updates and a weekly digest. Today, these toggles only change local application state in your browser session. They do not yet persist to a real, server-side preference store, and turning one off does not yet stop the corresponding message from being sent, because no message-sending pipeline currently reads that preference. We are flagging this plainly: it is a gap being fixed, not a working preference center. Do not rely on a toggle being off as a guarantee that a category of message will not arrive.
5. Transactional Email Is Different
Once the separation described in Section 6 is built, VLStudio intends to keep transactional email (billing receipts, password-reset emails, and security notices) separate from marketing email as a matter of both product design and legal basis. Transactional email is sent to operate your account and fulfil our contract with you, not on a marketing legal basis, and it is not something you can opt out of while keeping your account functional: you cannot ask to stop receiving a password-reset email you requested, or a receipt for a charge that was made, without effectively asking us to stop servicing your account.
Today, the technical separation between transactional and marketing sending paths is still being formalized; this section states the intended end state so the distinction is clear once it ships.
6. What We Are Building
To close the gaps described above, we intend to build, in this order of priority:
- A real, server-side preference store that the notification toggles actually write to and that our sending pipeline actually reads before sending a marketing message.
- A functioning one-click unsubscribe link in every marketing message, consistent with PECR/GDPR requirements.
- An auditable consent record (source and timestamp) for every marketing subscriber.
- A clean technical separation between the transactional and marketing sending paths described in Section 5.
Until these ship, treat any promise elsewhere on this site of "unsubscribe at any time" or "you will stop receiving these immediately" as aspirational rather than a description of current behavior, and use Section 8 to act on a real request in the meantime.
7. Changes to This Notice
We will update this notice once the unsubscribe mechanism, preference store, and consent record described in Section 6 ship, replacing the honest "not yet functional" language with a description of the working mechanism.
